Our History

Upon graduation from Baylor Law School, Albert Weatherly began his practice in 1979 in his hometown of Nacogdoches. Starting out and building the firm, Albert practiced in many areas of law. Today, Albert’s primary areas of practice are estate planning, probate, elder law, business law and oil and gas. Albert received his board certification in estate planning and probate in 1997. Trish Smith has been affiliated with the firm since 2009 and is now of counsel. Kristen Burns joined the firm in the fall of 2019 and assists clients with estate planning, probate, and business law. The Weatherly Law Firm has served the communities and families in Nacogdoches and surrounding area for over 40 years and we look forward to serving our community for years to come.

Estate Planning

Estate planning is recommended to ensure that your estate passes according to your wishes and to authorize someone to make financial and healthcare decisions for you in the event of your disability or incapacity.

Probate is the legal process to distribute a person’s property after they die. If there is a Will, a Court will validate it so that the Will’s terms can be fulfilled. If there is no Will, the Court must determine the Decedent’s heirs.
